Confidential Information shall not include the following: information already in the public domain at the time of this contract, information within the possession of seller prior to execution of this agreement; and information disclosed to seller by a third party, which does not, in making such disclosure, breach an obligation of confidentiality to buyer. Endee acknowledges that the products of our buyer, private client, contract and private label client's information concerning the use, distributing, design and manufacture of said products, constitutes their valuable trade and personal secrets. Endee Global Inc. Maintains as confidential all such technical and cosmetics information or other information, which is made available undisclosed to the third party.
